1. Acceptance of Terms

By accessing or using the Getquwwa platform ("Platform", "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Platform. These Terms form a legally binding agreement between you and Quwwa Information Technology Company, trading as Getquwwa, registered in Saudi Arabia at Jeddah, Saudi Arabia.

2. Description of Service

Getquwwa is a Software-as-a-Service (SaaS) platform for gym and fitness facility management in Saudi Arabia and the MENA region. The Platform provides member management, QR attendance tracking, class scheduling, payment recording, staff management, reporting, and a companion mobile app for gym members. Access is available via a web dashboard and mobile application.

3. Account Registration

Gym owners register with a valid email and password. Gym members authenticate via phone OTP through the mobile app. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately at help@getquwwa.com of any unauthorised use.

4. Free Trial, Subscription, and Billing

Getquwwa offers subscription plans billed monthly or annually. Gym subscription prices are displayed in Saudi Riyals (SAR) and are VAT-exclusive unless stated otherwise; 15% VAT applies as required by Saudi law. Member renewal payments are VAT-inclusive.

New gym accounts receive a 14-day free trial with full platform access. No payment is required during the trial.
When the trial ends, you must subscribe to a paid plan before continuing to use the dashboard or platform features. Users with an active trial or active subscription retain full access.
We accept payment via Moyasar (card, MADA, Apple Pay, STC Pay), bank transfer, and cash. Bank transfer and cash payments require admin verification before your subscription is activated.
Subscriptions renew at the end of each billing cycle unless cancelled before the renewal date.
We may modify pricing with at least 30 days' advance notice. Continued use after the effective date constitutes acceptance.

5. Gym Owner Responsibilities

As a gym owner, you agree to:

Ensure all member data you enter is accurate and lawfully obtained.
Obtain necessary consent from members before processing their personal data through the Platform.
Keep account credentials secure and restrict access to authorised staff.
Comply with applicable Saudi commercial and labour regulations.
Use the Platform only for legitimate gym and fitness facility management.

6. Acceptable Use

You agree not to:

Violate any applicable laws or regulations.
Upload malicious code or interfere with Platform operations.
Attempt unauthorised access to other accounts or systems.
Scrape, copy, or reverse-engineer any part of the Platform.
Impersonate any person or entity.

7. Data and Privacy

Your use of the Platform is governed by our Privacy Policy (linked in the footer). You act as the data controller for your gym members' data; Getquwwa acts as a data processor. You are responsible for PDPL compliance regarding member data.

8. Intellectual Property

The Platform, including all software, design, and trademarks, is owned by Quwwa Information Technology Company. You receive a limited, non-exclusive, non-transferable licence to use the Platform for gym management during your subscription term.

9. Limitation of Liability

To the maximum extent permitted by law, Quwwa Information Technology Company shall not be liable for indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the subscription fees paid by you in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your account for material breach or fraud. Upon termination:

Access ceases at the end of the current billing period (if you cancelled) or immediately (if we terminated for breach).
Your data is retained for 90 days, after which it is permanently deleted. You may request an export during this window.

11. Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes shall be subject to the exclusive jurisdiction of the competent courts of Saudi Arabia.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or Platform notice at least 14 days before they take effect.
